MIDDLEBURG – A speeding ticket evolved into what the Clay County Sheriff’s Office described as a fight between two deputies, a K-9 deputy and a suspect who was charged for the fourth time in less than 10 years for driving under the influence of alcohol or drugs on Thursday, March 27.
David Wayne Loving, 54, of Jacksonville, was charged with DUI, two counts of resisting law enforcement officers with violence and causing harm to a law enforcement service animal after a deputy clocked Loring going 67 mph in a 45-mph zone on State Road 21 in Middleburg. When he attempted to pull Loving over, he turned right onto County Road 220 and stopped.
The deputy noticed “the strong odor of an unknown alcoholic beverage emanating from the defendant’s facial area.” He performed a field sobriety test and determined that Loving was impaired. According to the arrest report, when he attempted to arrest him, Loving became combative.
Loving was tasered after he wrestled and elbowed two deputies in the torso, which prompted them to use their tasers. Other units arrived, K-9 Mak bit Loving, and Loving grabbed Mak by the neck before the deputies gained control.
Loving’s bond was set at $115,012.
